Tenancy agreement changes

New tenant signing a tenancy agreement

Why make changes?

Ashfield District Council intends to update the terms and conditions of its Introductory and Secure Tenancies. This last took place in 2005 and as it is good practice to keep tenancy agreements up to date, this review has been carried out. The reason why the Council is doing this is to make the tenancy agreement easier to understand, and to comply with what the law says a tenancy agreement should include.

About the changes

Earlier this year, we sent a letter, called a Preliminary Notice of Variation, to all Ashfield District Council Introductory and Secure tenants informing you of our intention to serve a notice that will vary your conditions of tenancy.  Please note that we are not proposing to end your tenancy but merely to change the terms and conditions of your existing tenancy agreement. You will therefore not be asked to sign a new tenancy agreement, but the changes will still apply to you.

What are the changes?

You can download from here the proposed new tenancy agreement, plus the existing agreement so that you can compare.  A full copy of the proposed agreement can also be obtained from any of our property shops or by phoning us on 01623 608999.

There is also a guide to the changes, plus some frequently asked questions with answers.

Thanks for your input

The closing date for comments on the proposed changes was the 17th September 2010 and we thank all those tenants who contacted us with their views.

What happens next?

We have taken all the comments we received into consideration and formal approval from Ashfield District Council to make the changes has been given. During December 2010, we will serve you with a formal Notice of Variation (under Section 103 of the Housing Act 1985). This will include a copy of the new tenancy agreement which will take effect from 10th January 2011. See the links below for copies of the Notice, the new tenancy agreement and a timetable of the changes.
